Bio-Pen has a significant impact on public health systems.

New rules on electronic and digital signatures have been published on Gazzetta Ufficiale 117 on 21/05/2013. Specifically, the impact on public health system is ruled by the following article.

Art. 57 – Obligations for subjects who provide advanced electronic signature solutions

5. In relation to public administrations and health systems for citizens who benefit from health services, the declaration of acceptance of service conditions stated in comma 1a) can be orally provided by the user to the public servant or the health professional, who collects it in an electronic document subscribed with qualified electronic or digital signature.

Acts subscription with advanced, qualified or digital electronic signature can apply to all those contracts that require the written form "ad substantiam", to ensure the validity of the act or contract. The privacy consensus for sensitive data and the informative consensus on medical treatment are included in this field of application.

What is the impact on Bio-Pen on these processes? Beside the elimination of consensus paper copy, it allows to stop using various signature tools as they are replaced by a single device.

It is reasonable to think that the process would be carried out with Bio-Pen used as FEA both for the registration of consent by the citizen-patient (defined in some cases "beneficiary") and for the closure of acceptance document as stated in art. 57 comma 1a), while avoiding complex document flows and/or different signature devices.

In order to use Bio-Pen in its FEA (Electronic Advanced Signature) option with PenSign application, it will be enough to register the public servant or the health professional.
